Annual Parapet Observation

The Requirement

Beginning January 1, 2024, every building owner must have an observation of the parapet on their building performed in accordance with the requirements of Section 28-301.1.1 of the New York City Administrative Code. This requirement applies to all buildings with parapets fronting the public right-of-way, regardless of height.

The observation must include close-up inspections of the entire parapet which could be conducted from a fire escape or roof. See 1 RCNY §103-15 for more information on observation and report requirements.

Owners must maintain the observation reports for at least six (6) years and must make such reports available to the Department upon request.

An exterior wall is considered part of the public right-of-way if anyone from the general public, unaffiliated with the property, can freely approach and access the building's facade.

Buildings with continuous barriers located within a perpendicular distance equal to or less than half the height of the exterior wall must also undergo inspection.

Who Can Perform the Observation

Qualified Individuals

This includes, but is not limited to:

A bricklayer, building superintendent, handyman, mason or a person in a similar construction-related trade

A NYS-licensed architect or engineer

A NYS-authorized building inspector

An inspector working for a NYS-authorized insurance company

Any other individual capable of identifying hazards on the parapet

Exempt Buildings

✕ Detached one- or two-family homes

✕ Buildings with a fence or other barrier preventing access to the exterior wall

Who Is Affected

Who Is Affected by the New Parapet Inspection Regulation?

This law applies to all buildings in New York City with parapets fronting a public right-of-way, regardless of the building's height. Detached one- or two-family homes and buildings with barriers preventing public access to the exterior wall are exempt from this requirement.

Commercial Buildings

Inspection Scope

What Does the Inspection Involve?

Annual parapet inspections must include a thorough, close-up examination of the entire parapet. This can be done using scaffolds, boom trucks, or by accessing the parapet from fire escapes or rooftops. Inspectors must evaluate:

Parapet Alignment

Verify that the parapet remains plumb within one-eighth of its cross-sectional thickness and does not exhibit movement, leaning, or conditions that may indicate structural instability.

Excessive Deterioration

Inspect for excessive deterioration including displacement, horizontal or diagonal cracking, loose bricks, coping stones, deteriorated mortar joints, spalling, rot, and other visible defects.

Appurtenance Stability

Verify that railings, roof access equipment, ladders, signs, telecommunications equipment, and other parapet appurtenances are properly installed and maintained in a stable condition.

Cornice Condition

Cornices attached to parapet walls are not exempt from the observation requirement and must be evaluated as part of the annual parapet safety assessment.

Overall Safety Classification

The observation report must classify the parapet as safe, unsafe, or requiring maintenance and document any conditions requiring repair or corrective action.

FISP Integration

In years when a building undergoes FISP inspection, the FISP report may serve as the parapet observation report if all required information is included.

Documentation

Reporting Requirements for Parapet Inspections

The person performing the observation or the owner in consultation with the person performing the observation is required to prepare a report of the observation. The report must include, but not be limited to, the following information:

The address of the property

The address and any other associated addresses for the building

Owner Information

The name, mailing address and telephone number of the owner of the building, or, if the owner is not an individual, the name, mailing address, telephone number, and position/title of a principal of the owner.

Inspector Information

The name of the person performing the observation, if other than the owner, their mailing address, telephone number, affiliation with the building or owner, and business name, if applicable.

The date(s) of the observation

Exact date(s) the parapet observation was performed.

The location plan of the parapet(s) observed

A plan identifying the specific location of each parapet observed on the building.

Construction of the parapet

Including, but not limited to, material, height, and thickness.

General conditions noted

Whether any unsafe conditions were found, and actions taken to remedy the unsafe conditions.

Hazardous or Unsafe Conditions

Notifications of Hazardous or Unsafe Conditions

If hazardous or unsafe conditions are identified during the observation, the following steps are legally required:

Step 01

Notify DOB Immediately

The person performing the observation must immediately notify DOB by calling 311 and emailing parapets@buildings.nyc.gov when a hazardous or unsafe condition is identified.

Step 02

Install Public Protection

The owner must immediately install public protection measures, such as sidewalk sheds, fencing, or safety netting, to secure the area and protect the public until repairs are completed.

Step 03

Correct All Unsafe Conditions

Unsafe conditions must be corrected within ninety (90) days from notification to DOB. Public protection measures must remain in place until the hazardous condition has been fully remedied.

Step 04

Sidewalk Shed Filing in DOB NOW

If a sidewalk shed is required, the applicant must indicate that it is related to the building's required periodic parapet observation when completing the DOB NOW filing process.

Deadlines for Parapet Inspections

Annual parapet inspections must be completed, and the observation report must be filed by December 31 of each year. Failure to meet the inspection deadline could result in penalties and fines, as well as potentially hazardous conditions remaining unchecked.

Building owners are responsible for maintaining parapet observation reports for a minimum of six years. These records must be made available to the Department of Buildings upon request.
